Terms and conditions of sale:

1. Handmade Hammocks Limited Conditions Apply:

Unless specifically agreed in writing by Handmade Hammocks Limited ("HH"), all quotations & contracts for the supply of goods by "HH" are made upon these Conditions of Sale ("HH Conditions of Sale"), which shall at all times override any terms & conditions which the purchaser of goods ("the Purchaser") imposes or seeks to impose. Orders are accepted subject to the Company's Conditions of Sale.

2. Making a Purchase

Making a purchase could not be easier. Just browse our Catalog, and click on any items that you wish to buy and put them into the shopping cart. After you have finished your selection, click on "Order" and you will be asked for a few details that we need to be able to satisfy the order.

We accept credit card payment. If you are shopping from North America or anywhere else, place your order and your credit card company will convert the transaction to US Dollars or your own currency.

We accept Visa and Mastercard. We do not charge for any item until it is ready to ship. Backordered items are not charged until they are shipped. You may send your credit card information via phone, fax, snail mail or over the Internet.

On-line credit & debit card transactions are processed via our own merchant service facility. Your card details are encrypted using the latest software & are processed using a secure server. At no stage during transmission over the web are your details visible. All payments are taken using Protx to provide a secure payment page.

If you do have concerns regarding on-line payment or do not have a credit/debit card you can still order on line. At the checkout stage you will be given the option to pay by another method. We are able to accept cheques, postal orders & cash.

3. Acceptance of Order

Acceptance & the completion of the contract between you & "HH" will take place on the despatch of your order to you unless we have notified you that we do not accept your order or you have cancelled it in accordance with the instructions set out in our Code of Conduct - Your Right To Cancel. Non-acceptance of an order may be a result of one of the following: the product you ordered is unavailable from stock and/or manufacturer, our inability to obtain authorisation for your payment &/or the identification of a pricing or product description error. "HH is responsible for the website transaction save for any errors which have been imputed by the customer.

4. Payment Terms:

Terms of payment are strictly net. If payment is being made by cheque (without a valid cheque guarantee card) "HH" reserves the right to withhold delivery until the cheque has cleared. In the event of a cheque being returned by the "Purchaser's" Bank for any reason "HH" shall be entitled to charge the "Purchaser" interest on any unpaid amount at the rate of 3% above the Bank of England's base rate until full payment is made. The "Purchaser" will indemnify "HH" in respect of all costs incurred by "HH" in recovering payment: including, legal fees & charges as well as any Bank charges incurred by "HH"

5. Prices:

All prices displayed in our on-line catalogue are the actual prices you pay. There are 'NO HIDDEN EXTRAS' & the only other charge that may be made is for carriage to areas outwith the UK, if applicable. We have NO MINIMUM ORDER value so please feel free to order whatever you want. Prices are correct at the time of publishing & may be subject to change without prior notice.

6 .Your Right to Cancel:

Our customers have the right to a "cooling off period" where all goods ordered from "HH" may be cancelled within 7 working days without giving a reason. Should you wish to cancel you will be responsible for paying for the goods to be returned in their original condition. Monies will be returned to you within 28 days of receipt of your cancelled order. Please note that refunds can only be made to the credit/debit card you used at the time of placing your original order.

7. Title of Goods:

Legal title of goods passes to the "Purchaser" when "HH" has received payment in full although the risks therein passes to the "Purchaser" at the time of delivery. Until such time as payment has been made in full the "Purchaser" shall hold the goods as "HH's" fiduciary agent & bailee & shall indemnify "HH" against any loss, deterioration or damage howsoever caused & should ensure that the goods are properly stored, protected, insured & identified as the property of "HH".

6. Delivery:

Goods are normally dispatched with by carrier, Royal Mail or Parcel Force the same or working day following receipt of order. Delivery charges will be confirmed at the 'checkout stage' of the order process. Goods are fully insured during transit (at no extra cost) up to a maximum of the total invoice value.

Delivery Schedule - Deliveries within mainland UK are normall next working day unless they are to the Scottish Highlands and Scilly Isles where delivery may take up to 5 working days. For deliveries outside the UK we will e-mail you with an estimated delivery time once your order has been processed.


Back Orders - Although we maintain high stock levels, occasionally goods may be temporarily out of stock or on back order, in such cases we will inform you within 48 hours of receiving your order.


Terms & conditions of Delivery - are applicable in the UK only. For delivery outside the UK please contact our Sales Department. By completion of an order, the customer agrees that despatch shall take place upon receipt by "HH" payment of the purchase price in full. "HH" will endeavour to meet any delivery date quoted, however dates are given & intended as an estimate only. "HH" shall not be held responsible for any delay in the delivery of goods howsoever caused, nor shall it be liable for any damage, consequential loss or expense arising from failure to deliver goods by a due date.Claims for shortages or damaged goods must be received in writing by "HH" within 3 days of the receipt of goods. The "Purchaser" should ensure at the time of delivery that goods are signed for as damaged or incomplete, failing which "HH" will not be liable in respect of any such claim & goods shall be deemed to have been delivered in a complete & satisfactory condition. Claims for non-delivery MUST BE MADE IN WRITING TO BOTH "HH" & THE CARRIER (Royal Mail, Parcel Force & APC) & should be received by "HH" within 14 days of ordering. All delivery outwith mainland UK are made subject to UK export regulations and the import regulations governing the country in question. For the avoidance of doubt all import taxes payable in the country of delivery are the responsibility of the customer.

7. Guarantee

We want you to be satisfied with your purchases every time you do business with us. So to make things simple we offer a "NO QUIBBLES GUARANTEE". If for any reason you are unhappy with your purchase simply tell us upon receipt of the goods & return them in their original condition within 10 days - we will then issue a refund less the cost of carriage and in the case of hammock stands, a repackaging fee.. If you are returning goods as a result of our error, we will also refund the delivery charge. To make a return, please wrap the goods in secure packaging enclosing a note telling us why you are returning them. Please obtain a written receipt from whomever you chose to return the goods with (i.e. proof of postage).

8. Returns Policy

If for any reason you are unhappy with your purchase simply tell us upon receipt of the goods & return them in their original condition within 10 days - we will then issue a full refund, less the cost of carriage and in the case of hammock stands, a repackaging fee. If you are returning goods as a result of our error, we will also refund the delivery charge provided that this is by Royal Mail Standard Parcel service. To make a return, please wrap the goods in secure packaging and particularly in the case of frames ensure the metal fittings are indivually wrapped to avoid chipping as we cannot give a full refund where goods are damaged. Please enclose a note telling us why you are returning them. Please obtain a written receipt from Royal Mail (i.e. proof of postage).

8. Liability:

The following terms apply except in the case of death or personal injury caused by "HH's" negligence: Risks in the goods pass to the Purchaser on delivery & "HH" shall not be liable for any loss, damage or deterioration of goods howsoever caused. The Purchaser shall keep "HH" fully indemnified against all loss &/or liability arising from any such loss, damage or deterioration.If loss, damage or deterioration (except for death or personal injury) is caused by "HH's" negligence, "HH's" liability shall be limited to the invoice value of the goods.All conditions & warranties regarding the quality & fitness for any particular purpose of goods supplies (whether statutory or otherwise) are expressly excluded but (without prejudice) every care will be taken to ensure goods supplied will conform to "HH's" standards or specifications (within the limits of reasonable commercial tolerance & accuracy). If "HH" identifies that goods supplied do not conform to its standards or specifications "HH" will, in assessing the value of any allowance or replacement it may agree to make, have regard to the nature/extent of the defect, information given by the Purchaser regarding it's application, the use already made of the goods & any other relevant factor. In any event "HH's" maximum liability shall be limited to the invoice value of the goods."HH" accepts no liability for any damage to property or consequential loss attributed to the failure of goods supplied, whether due to abuse, accident or incorrect technical assessment by "HH" or its employees or for any other reason

9. Product Information:

"HH" has made every effort to ensure details & information given in our on-line catalogue is correct at the time of publishing. Exhaustive technical specifications are not included & as such the Purchaser should check any details & information they wish to rely on with "HH" at the time of purchase. The application & use of goods is the absolute responsibility of the "Purchaser". "HH" cannot accept liability in respect of any omissions or errors contained herein or for any loss, damage, consequential loss or malfunction arising from reliance upon our on-line catalogue. "HH" reserves the right to alter any information & details as the need arises. As we are continually trying to improve our product range, we reserve the right to provide an alternative product from those shown in our on-line catalogue. In such cases goods will be of the same standard & specification, & intended to serve the same purpose.

10. Indemnity Against Infringement of Patents & Rights:

The "Purchaser" shall indemnify "HH" against all damages, penalties, costs & expenses to which we may be liable as a result of work done or goods supplied in accordance with the "Purchaser's" specification which involves the infringement of any registered design, letter patents, intellectual property rights, proprietary process or otherwise.

 

11. Disclaimer:

Any products featured in our on-line catalogue or links to other sites contained within our website do not represent endorsement by "HH" of any products, services or organisations.

"HH" does not sell CAA prohibited goods and services.

12. Colour Reproduction:

Colour reproductions of goods featured in our on-line catalogue & colour swatch are as accurate as the electronic process will allow & may vary slightly from those delivered.

13. Amendments:

"HH" reserves the right to amend it's Terms & Conditions at any time & without giving prior notice.

14. Jurisdiction:

These terms & conditions shall be governed by & constructed in accordance with the laws of Scotland & the "Purchaser" agrees to submit to the jurisdiction of the Scottish Courts.

15. Copyright:
